Terms of Service for SwiftBiu

Please read these Terms of Service ("Terms") carefully before using SwiftBiu ("the App") operated by SwiftBiu ("we," "our," or "us").

By downloading, installing, or using SwiftBiu, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using SwiftBiu, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and agree to comply with these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use SwiftBiu on Apple macOS devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

This license does not allow you to:

  • Copy, modify, or distribute the App.
  • Reverse-engineer, decompile, or disassemble the App.
  • Rent, lease, lend, sell, or sublicense the App.
  • Use the App for any unlawful purpose.
  • Remove or alter any proprietary notices in the App.

3. User Content & Processing

  • Local Processing: SwiftBiu is a local utility. Any text selection, file processing, clipboard history, or OCR text captured is processed locally on your Mac. We do not inspect, collect, or store your User Content.
  • Third-Party Services: When you choose to trigger external integrations (such as AI models or Translation APIs), your text or files are sent to those third-party providers. You are subject to the terms of those respective providers.
  • Responsibility: You are solely responsible for the text and files you process using SwiftBiu, including ensuring you have the legal right to process or transmit them.

4. Pro Purchases and Subscriptions

  • Freemium Model: SwiftBiu offers free features and premium (Pro) features that require purchase.
  • Pro Licenses: Pro features are unlocked via a one-time purchase or subscription through Apple's In-App Purchase system or directly through our official website.
  • Billing & Refunds: Payments are processed securely via Apple's In-App Purchase system or our designated website payment providers. Billing, subscriptions, and refund requests will be handled by Apple or our respective web payment processors in accordance with their standard policies.
  • Feature Updates: We reserve the right to modify, add, or remove Pro features at any time.

5. Intellectual Property

SwiftBiu and its original content, features, and functionality (including logo, assets, design, and code) are the exclusive property of SwiftBiu and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Disclaimer of Warranties

SwiftBiu is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

  • The App will function uninterrupted or error-free.
  • Any defects or errors will be corrected immediately.
  • The App is free of viruses or other harmful components.
  • The results of using the App will meet your requirements.

7. Limitation of Liability

In no event shall SwiftBiu, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App.
  • Any conduct or content of any third party on the App.
  • Any content obtained from the App.
  • Unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by updating the "Last Updated" date at the top of this document.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
